Diagnostic Privilege Education & Experience Regulations Posted

NYMHCA's lobbyist, Heather Evans of Hinman Straub Advisors, is closely monitoring the roll out of the regulations for the diagnostic privilege law. This is a lengthy process that could go on for a year or more since the bill was passed on June 24th, 2022. NYMHCA has submitted your concerns to the State Education Department, but unfortunately, the department has not accepted our recommendations for allowing those in private practice to hire off-site supervisors to acquire the additional hours required for the diagnostic privilege.

Another issue in the drafted regulations about one of the pathways to obtaining the privilege is currently being discussed with SED and they are being asked for clarification on the issue or a redrafting of the regulation. The current regulations can be found here: https://dos.ny.gov/march-29-2023vol-xlv-issue-13
*Please note, these regulations will likely be redrafted.
