NYS Board of Regents Adopts Diagnostic Privilege Regulations for Supervised Experience

Emergency regulations adopted on July 12, 2022, for Limited Diagnostic Permits (acceptable settings and supervisors) and the requirements for the diagnostic privilege were formally adopted and implemented by the New York State Board of Regents Professional Practice Committee, after a 60-day public comment period, on November 30, 2022. The proposed regulations can be found here.

The Professional Practice Committee met on Monday, November 14, 2022, at which time they reviewed the proposed regulations and unanimously voted to adopt them as permanent. A report of the meeting can be accessed here.

The NYS Education Department Office of Professions will present additional regulation for consideration in 2023, related to other areas of the Diagnostic Privilege Law passed in June 2022.

NYMHCA will continue to monitor changes and updates to regulations and processes related to the Mental Health Practitioner Diagnostic Privilege Law.
